Terms of Use

1. Scope and Provider

(1) These Terms of Use govern the use of the online platform Ablefy Community Platform ("Platform", "Community", "Service"), operated by ablefy GmbH, Potsdamer Str. 125, 10783 Berlin.

(2) The Platform is aimed at digital entrepreneurs, coaches, creators, and SaaS providers who wish to manage their communities, content, and interactions.

(3) By registering for and using the Platform, you ("User") agree to these Terms of Use. If you do not agree, you may not access or use the Platform.

2. Description of the Service

(1) The Ablefy Community Platform is a cloud-based online service that allows users to:

  • Create and manage their own communities
  • Invite members and assign roles
  • Publish content (posts, comments, files, media)
  • Use AI-assisted features (e.g., content suggestions, analytics)
  • Access the Platform in multiple languages (English and German)

(2) The Platform may include features for analytics, moderation, notifications, file management, and statistics.

(3) ablefy merely provides the technical infrastructure. The respective community owners are responsible for the content and conduct within their communities.

3. Registration and User Accounts

(1) Access to the Platform requires a user account created through the authentication system Clerk.

(2) Registration requires a valid email address and full name.

(3) Users must keep their login credentials confidential and may not share their account with third parties.

(4) Ablefy reserves the right to suspend or delete user accounts in the event of a violation of these Terms, misuse, or security concerns.

4. Roles, Permissions, and Responsibilities

(1) The Platform supports three user roles: Owner, admin, and member.

(2) Roles and permissions:

  • Owner: Full access to community settings, rooms, members, and content. May delete the community, assign roles, or transfer ownership.
  • Admin: Can manage rooms, create or edit posts, and invite members. Cannot delete the community or remove the owner.
  • Member: Can read and (if permitted) create posts or comments. No administrative privileges.

(3) Owners and Admins are responsible for moderation, compliance with community guidelines, and appropriate communication within their communities.

5. User Content and Obligations

(1) Users may upload or publish content (text, images, documents, videos, links) in supported formats.

(2) Users agree not to upload or publish content that:

  • Violates applicable laws or third-party rights
  • Contains offensive, defamatory, or discriminatory material
  • Promotes violence or harmful behavior
  • Contains spam, advertising, or malware

(3) Users retain ownership of the content they create. By uploading or publishing content, users grant Ablefy a non-exclusive, worldwide, royalty-free license to store, display, and process such content as necessary to operate the Platform.

(4) Content may be removed by community admins or Ablefy if it violates these Terms or applicable law.

6. AI Features

(1) The Platform includes AI-powered features that may provide content suggestions, text generation, or community analytics.

(2) AI-generated content will be clearly identified where applicable.

(3) Data processing for AI features is carried out in accordance with the Ablefy Privacy Policy and serves solely to improve user experience.

7. Data Protection, Visibility, and Security

(1) The processing of personal data is carried out in accordance with the Ablefy Privacy Policy and the General Data Protection Regulation (GDPR).

(2) In the course of using the Platform, the following personal data may be collected and processed:

  • Full name or display name
  • Email address
  • Profile image or avatar
  • Community memberships and roles
  • Created content (posts, comments, files, uploads)
  • Technical usage data (e.g., IP address, device type, log files)

(3) Visibility within the Platform:

The following data may be visible to other registered users within the same community:

  • Display name or full name
  • Profile image or avatar
  • Role within the community (e.g., Owner, Admin, Member)
  • Published content (posts, comments, files)

Private data such as email address, internal identifiers, or technical logs are not publicly visible and are used solely for authentication, communication, and service provision.

(4) Ablefy applies appropriate technical and organizational security measures (e.g., encryption, access control, backups).

8. Intellectual Property

(1) The Platform, its design, source code, trademarks, and content are protected by copyright and other intellectual property laws.

(2) Users may only use the Platform as intended. Any reproduction, modification, distribution, or public display of Platform content requires prior written consent from ablefy GmbH.

(3) Users may only upload or share content for which they hold the necessary rights.

9. Liability

(1) ablefy is not responsible for user-generated content. Such content does not reflect the opinions or values of ablefy GmbH.

(2) The Platform is provided "as is." Ablefy does not guarantee uninterrupted availability and is not liable for data loss, system failures, or damages unless caused by intent or gross negligence.

(3) Liability for indirect or consequential damages, including lost profits, is excluded to the extent permitted by law.

10. Termination

(1) Users may delete their accounts or stop using the Platform at any time.

(2) Ablefy may suspend or terminate accounts or communities if:

  • These Terms are violated
  • Legal provisions are breached
  • The service is misused

(3) Upon termination, access to the Platform is revoked. Content may be deleted or anonymized.

11. Modifications to the Platform and Terms

(1) Ablefy reserves the right to modify the Platform, its features, or these Terms where there is a legitimate interest.

(2) Significant changes will be communicated to users in advance. Continued use of the Platform after changes take effect constitutes acceptance.

12. Governing Law and Jurisdiction

(1) These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on the International Sale of Goods (CISG).

(2) The place of jurisdiction for all disputes arising out of or in connection with these Terms shall, to the extent legally permissible, be the registered office of ablefy GmbH.
